2. Geltungsbereich

2.1. Diese allgemeinen Geschäftsbedingungen (AGB) gelten für die Jahreskarte (für den Erwerb der Jahreskarte und für den Besuch von Ausstellungen) der Leopold Museum-Privatstiftung (in der Folge kurz „Leopold Museum“ genannt). Die aktuellen Ausstellungen und Öffnungszeiten können der Webseite des Leopold Museum (www.leopoldmuseum.org) entnommen werden. Das Leopold Museum behält sich vor, Ausstellungen abzusagen oder abzuändern. Aufgrund von notwendigen Arbeiten, wie beispielsweise Ausstellungsauf-, -ab- oder -umbauten, kann es zu Teilschließungen kommen.

2.2. Mit der Bestellung akzeptiert die Kundin/der Kunde die AGB. Es gelten ausschließlich diese AGB. Abweichende Bedingungen werden vom Leopold Museum nicht anerkannt, es sei denn, das Leopold Museum stimmt Abweichungen ausdrücklich schriftlich zu.

2.3. Sollten einzelne Bestimmungen dieser AGB zwingenden gesetzlichen Vorschriften ganz oder teilweise widersprechen, so behalten die übrigen Bestimmungen dieser AGB dennoch ihre Gültigkeit.

2.4. Die Hausordnung ist in der jeweils gültigen Fassung auf der Webseite (www.leopoldmuseum.org/de/hausordnung) abrufbar. Mit dem Erwerb der Jahreskarte akzeptiert der Kunde/die Kundin diese Hausordnung.

 

3. Preise

Die aktuellen Preise der Jahreskarte können der Webseite (www.leopoldmuseum.org) entnommen bzw. an der Museumskassa (Kassascreens, Jahreskarten-Folder) eingesehen werden. Alle Preise enthalten die gesetzlich vorgeschriebene Umsatzsteuer. Das Leopold Museum behält sich Änderungen in der Preisgestaltung vor.

 

4. Leistungsanspruch

Ein Leistungsanspruch besteht nur auf die vom Leopold Museum gewährten Leistungen, die dem Einfluss des Unternehmens unterliegen und im Leistungsumfang der Jahreskarte enthalten sind. Das Leopold Museum behält sich allfällige Änderungen der enthaltenen Leistungen vor und übernimmt keine Garantie für die Gewährung von Zusatzleistungen Dritter, welche sich nach dem Ermessen des jeweiligen Kooperationspartners ändern können.

 

5. Ermäßigte Jahreskarte

5.1. Derzeit gelten folgende Vorrausetzungen um Anspruch auf die ermäßigte Jahreskarte zu haben:

• Alter: Geburtsdatum unter 30 Jahren bzw. ab 65 Jahren
• Behinderung
• Mitgliedschaft im Kunsthistoriker- bzw. Kunstvermittlerverband

Es besteht kein Rechtsanspruch auf den Erhalt einer Ermäßigung. Das Leopold Museum behält sich Änderungen bei den Ermäßigungen vor.

5.2. Wurde bei Vertragsschluss die Ermäßigung unberechtigt in Anspruch genommen, wird die Jahreskarte ungültig. Die Stornierung der ermäßigten Jahreskarte und gleichzeitige Kauf einer regulären Jahreskarte ist möglich, andernfalls kann der Eintritt in das Museum verwehrt bzw. die Kundin/der Kunde des Museums verwiesen werden. Der bereits bezahlte Betrag wird in diesem Fall nicht – auch nicht teilweise – rückerstattet.

 

6. Vertragsabschluss

6.1. Vertragssprache ist Deutsch.

6.2. Bei Online-Kauf:
Die Kundin/Der Kunde gibt nach Wahl der gewünschten Jahreskarte und korrekter Eingabe aller erforderlichen Angaben im Online-Bestellformular ein Angebot zum Kauf der von ihr/ihm ausgewählten Jahreskarte ab. Die Bestellung ist nur möglich, wenn alle Pflichtfelder (mit * gekennzeichnet) ausgefüllt sind. Die Annahme des Angebots durch das Leopold Museum erfolgt durch Übermittlung einer Bestätigung per E-Mail an die angegebene Mail-Adresse. Diese E-Mail enthält die digitale Version der Jahreskarte (als PDF- bzw. Wallet-Download). Optional kann sich die Kundin/der Kunde zu einem späteren Zeitpunkt eine Jahreskarte im Scheckkartenformat an der Museumskassa ausstellen lassen.

6.3. Bei Kauf an der Museumskassa:
Die Kundin/Der Kunde gibt nach Wahl der gewünschten Jahreskarte und korrekter Eingabe aller erforderlichen Angaben im Bestellformular im Jahreskarten-Folder bzw. an den Tablets an der Museumskassa ein Angebot zum Kauf der von ihr/ihm ausgewählten Jahreskarte ab. Die Bestellung ist nur möglich, wenn alle Pflichtfelder (mit * gekennzeichnet) ausgefüllt sind. Die Annahme des Angebots durch das Leopold Museum erfolgt durch Übermittlung einer Bestätigung per E-Mail an die angegebene Mail-Adresse bzw. bei Nichtangabe einer E-Mail-Adresse durch die Bezahlung und das Ausstellen der Karte an der Museumskassa. Die Jahreskarte kann je nach Kundenwunsch an der Museumskassa im Scheckkartenformat und/oder bei Angabe einer E-Mail-Adresse als digitale Version der Jahreskarte ausgestellt werden (die oben genannte Bestätigungs-E-Mail enthält in diesem Fall die digitale Version der Jahreskarte als PDF- bzw. Wallet-Download).

 

7. Bezahlung (Jahreskarte und Jahreskarten-Gutschein)

7.1. Die Jahreskarte kann je nach Kaufort mit verschiedenen Zahlungsmethoden bezahlt werden:

• An der Museumskassa: Barzahlung, EC-Karte, Kreditkarte (VISA, Mastercard)
• Online: eps-Überweisung, Kreditkarte (VISA, Mastercard)

7.2. Online:

• Zahlung mit eps-Überweisung:
  Die Zahlung per eps-Überweisung wird von unserem Partner Unzer abgewickelt, auf dessen Webseite die Kundin/der Kunde weitergeleitet wird, wenn eps-Überweisung als Zahlungsmethode ausgewählt wurde.
• Zahlung mit Kreditkarte:
  Die Zahlung per Kreditkarte wird von unserem Partner Unzer abgewickelt, auf dessen Webseite die Kundin/der Kunde weitergeleitet wird, wenn Kreditkarte als Zahlungsmethode ausgewählt wurde.

Nach Absenden der Bestellung ist der Kauf verbindlich und kann nicht mehr storniert oder modifiziert werden. Die Angaben der Kundin/des Kunden über die Kreditkarte werden vom Kreditkartenunternehmen überprüft. Die Angebote gelten erst als bezahlt, wenn die Angaben der Kundin/des Kunden bei dieser Überprüfung bestätigt worden sind und die Zahlung beim Leopold Museum vollständig eingelangt ist. Vom Kreditkartenunternehmen nicht bestätigte Beträge werden nachgefordert.

7.3. Kauf von Gutscheinen:
Beim Kauf eines oder mehrerer Gutscheine gelten dieselben Zahlungsmöglichkeiten wie beim Kauf der Jahreskarte.

7.4. Rücktritt/Umtausch von Jahreskarten und Jahreskarten-Gutscheinen:
Bezahlte Jahreskarten und Jahreskarten-Gutscheine können weder umgetauscht noch (teilweise) rückerstattet werden.

 

8. Nutzung der Jahreskarte

8.1. Gültigkeitsdauer: Die Jahreskarte ist ab Ausstellungsdatum 12 Monate (bis zum letzten Tag des jeweiligen Ablaufmonats) gültig und berechtigt, die auf der Jahreskarte namentlich genannte Person, zu unlimitierten Besuchen im Leopold Museum. Im Falle von auf Firmen ausgestellten Jahreskarten ist beim Museumsbesuch ein Nachweis der Firmenzugehörigkeit zu erbringen (z.B. ein gültiger Mitarbeiter*innen-Ausweis).

8.2. Die reguläre Jahreskarte (digital und im Scheckkartenformat) ist nicht übertragbar und nur in Kombination mit einem gültigen Lichtbildausweis gültig.

8.3. Für die ermäßigte Jahreskarte (digital und im Scheckkartenformat) sind folgende Legitimationen bei jedem Museumsbesuch vorzuzeigen:

• Altersnachweis: Amtlicher Lichtbildausweis mit einem Geburtsdatum unter 30 Jahren bzw. ab 65 Jahren.
• Menschen mit Behinderung: Behindertenpass.
• Mitglieder des Kunsthistoriker- und Kunstvermittlerverbands müssen neben dem amtlichen Lichtbildausweis auch einen Nachweis ihrer Mitgliedschaft im Kunsthistoriker- bzw. Kunstvermittlerverband erbringen.

8.4. Die Kundin/Der Kunde ist verpflichtet, die digitale Jahreskarte bei allen ihren/seinen Museumsbesuchen auf ihrem/seinem Mobilgerät vorzuweisen, sofern diese keine Jahreskarte im Scheckkartenformat besitzt. Die PDF der digitalen Jahreskarte kann auch in ausgedruckter Form vorgelegt werden. Der Kunde/Die Kundin ist in diesem Fall dafür verantwortlich, dass die ausgedruckte Jahreskarte leserlich ist. Ausgedruckte Jahreskarten, die unleserliche oder nicht überprüfbare Angaben enthalten, werden nicht akzeptiert. Die Kundin/Der Kunde darf nur ein einziges Druckexemplar der Jahreskarte anfertigen. Sie/Er hat alle zumutbaren Maßnahmen zu treffen, um eine Vervielfältigung der Jahreskarte auszuschließen.

 

9. Jahreskarten-Verlängerung

Eine Verlängerung der Jahreskarte kann frühestens am 1. des Monats erfolgen, in dem die Gültigkeit der Karte endet. Jahreskarten-Besitzer*innen werden automatisch per E-Mail ab dem frühestmöglichen Zeitpunkt, zu dem eine Kartenverlängerung möglich ist, informiert. Sofern eine Jahreskarte früher gekauft wird, handelt es sich nicht um eine Verlängerung, sondern um den Kauf einer von der vorherigen Jahreskarte unabhängigen neuen Karte und somit verfällt die ursprüngliche Laufzeit der bestehenden Karte.

 

10. Zustellanschrift und Kommunikation

Jahreskarten-Besitzer*innen verpflichten sich, dem Leopold Museum Änderungen ihrer/seiner Zustelladresse (E-Mail-Adresse und/oder Postanschrift) schriftlich bekanntzugeben. Unterlässt die/der Jahreskarten-Besitzer*innen dies, gelten Erklärungen des Leopold Museum als ihr/ihm zugegangen, falls das Leopold Museum diese an die letzte von der Karteninhaberin/dem Karteninhaber bekanntgegebene E-Mail-Adresse bzw. Postanschrift übermittelt.

 

11. Tracking

Alle Museumsbesuche werden mittels Einscannens des personalisierten QR-Codes der Jahreskarte erfasst (Person, Tag und Uhrzeit) und gespeichert. Auswertungen erfolgen nie personenspezifisch und dienen rein der Analyse des allgemeinen Nutzungsverhaltens und der Verbesserung des Besuchserlebnisses.

 

12. Haftung

12.1. Das Leopold Museum haftet nicht dafür, dass die Bestellung von Jahreskarten über die Webseite jederzeit möglich ist. Für Mängel aus welchem Rechtsgrund auch immer (z.B. Schäden aus Störungen, Fehlern oder Unterbrechungen sowie Mängelfolgeschäden) haftet das Leopold Museum der Kundin/dem Kunden nur, soweit diese schuldhaft oder grob fahrlässig vom Leopold Museum herbeigeführt wurden.

12.2. Die gesetzlichen Gewährleistungsansprüche, insbesondere für Verbraucher*innen, bleiben hiervon unberührt.

12.3. Die Kundin/Der Kunde ist verpflichtet, alle abgefragten Daten vollständig und korrekt anzugeben. Für unvollständige, unrichtige oder unklare Angaben haftet die Kundin/der Kunde für die daraus entstehenden Kosten.

 

13. Gewährleistung

Das Leopold Museum steht für Mängel im Rahmen der gesetzlichen Bestimmungen ein.

 

14. Datenschutz

15. Anzuwendendes Recht und Gerichtsstand

15.1. Der abgeschlossene Vertrag unterliegt österreichischem Recht unter Ausschluss der internationalen Verweisungsnormen.

15.2. Sämtliche aus oder im Zusammenhang mit diesem Vertrag resultierende Streitigkeiten sind bei allen zuständigen Gerichten mit Sitz in Wien auszutragen.

 

16. Änderungen dieser Geschäftsbedingungen

Änderungen dieser Geschäftsbedingungen werden der Karteninhaberin/dem Karteninhaber bekannt gegeben; die Bekanntgabe kann auch per E-Mail erfolgen. Die Karteninhaberin/der Karteninhaber genehmigt die geänderten Geschäftsbedingungen, wenn sie/er diesen nicht binnen 14 Tagen ab Zustellung der Bekanntgabe schriftlich widerspricht. Die Karteninhaberin/der Karteninhaber wird auf die 14-tägige Frist, den Fristbeginn, die Möglichkeit zum schriftlichen Widerspruch und die Bedeutung der Unterlassung des Widerspruchs in der Bekanntgabe hingewiesen werden. Das Leopold Museum behält sich das Recht vor, die Allgemeinen Geschäftsbedingungen jederzeit zu ändern.

2. Scope of application

2.1. These General Terms and Conditions (GTC) apply to the annual pass (to the purchase of the annual pass and to visiting exhibitions) of the Leopold Museum-Privatstiftung (hereinafter referred to as "Leopold Museum"). The current exhibitions and opening hours can be found on the website of the Leopold Museum (www.leopoldmuseum.org). The Leopold Museum reserves the right to cancel or modify exhibitions. Partial closures may occur due to necessary work, such as the assembling, dismantling or remodeling of exhibitions.

2.2. By placing an order, the customer accepts the GTC. These GTC shall apply exclusively. Deviating terms and conditions will not be recognized by the Leopold Museum unless the Leopold Museum expressly agrees to deviations in written form.

2.3. Should individual provisions of these GTC contradict mandatory statutory provisions in whole or in part, the remaining provisions of these GTC shall nevertheless remain valid.

2.4. The current version of the visitor policies is available on the website (www.leopoldmuseum.org/en/visitor-policies). With the purchase of the annual pass, the customer accepts these visitor policies.

 

3. Prices

The current prices of the annual pass can be found on the website (www.leopoldmuseum.org) or at the museum cash desk (screens, annual pass folder). All prices include the statutory value-added tax. The Leopold Museum reserves the right to change the prices.

 

4. Entitlement to benefits

Entitlement to benefits exists only for those services provided by the Leopold Museum which are subject to its control and are included in the scope of benefits of the annual pass. The Leopold Museum reserves the right to make changes to the services included and does not guarantee the provision of additional services by third parties, which may change at the discretion of the respective cooperation partner.

 

5. Reduced annual pass

5.1. At present, the following conditions apply in order to be entitled to the reduced annual pass:

• Age: date of birth under 30 years or 65 years or older
• Disability
• Membership in the Association of Art Historians and Art Educators

There is no legal entitlement to receive a reduction. The Leopold Museum reserves the right to make changes to the discounts.

5.2. If the discount was claimed without justification at the time of conclusion of the contract, the annual pass becomes invalid. Cancellation of the reduced annual pass and simultaneous purchase of a regular annual pass is possible, otherwise admission to the museum may be denied or the customer may be expelled from the museum. In this case, the amount already paid will not be refunded - not even partially.

 

6. Conclusion of contract

6.1. The contract language is German.

6.2. In the case of online purchase:
After selecting the desired annual pass and correctly entering all required information in the online order form, the customer submits an offer to purchase the annual pass selected by him/her. The order is only possible if all mandatory fields (marked with *) are filled in. The Leopold Museum accepts the offer by sending a confirmation e-mail to the e-mail address provided. This e-mail contains the digital version of the annual pass (as a PDF or Wallet download). Optionally, the customer can have an annual pass in credit card format issued at the museum cash desk at a later date.

6.3. Purchase at the museum cash desk:
After selecting the desired annual pass and correctly entering all required information in the order form in the annual pass folder or at the tablets at the museum cash desk, the customer submits an offer to purchase the annual pass selected by him/her. The order is only possible if all mandatory fields (marked with *) are filled in. Acceptance of the offer by the Leopold Museum is effected by sending a confirmation by e-mail to the e-mail address provided or, if no e-mail address is provided, by payment and issue of the card at the museum cash desk. Depending on the customer's wishes, the annual pass can be issued at the museum ticket office in credit card format and/or, if an e-mail address is provided, as a digital version of the annual pass (in this case, the above-mentioned confirmation e-mail contains the digital version of the annual pass as a PDF or Wallet download).

 

7. Payment (annual pass and annual pass voucher)

7.1. The annual pass can be paid using various payment methods, depending on the place of purchase:

• At the museum cash desk: cash, EC card, credit card (VISA, Mastercard).
• Online: eps-transfer, credit card (VISA, Mastercard)

7.2. Online:

• Payment by eps-transfer:
  Payment by eps-transfer is processed by our partner Unzer, to whose website the customer is redirected if eps-transfer is selected as the payment method.
• Payment by credit card:
  Payment by credit card is processed by our partner Unzer, to whose website the customer is redirected if credit card has been selected as the payment method.

Once the order has been sent, the purchase is binding and can no longer be cancelled or modified. The customer's credit card details will be verified by the credit card company. The offers are not considered paid until the customer's details have been confirmed during this check and the payment has been received in full by the Leopold Museum. Amounts not confirmed by the credit card company will be claimed subsequently.

7.3. Purchase of vouchers:
When purchasing one or more vouchers, the same payment options apply as when purchasing the annual pass.

7.4. Cancellation/exchange of annual passes and annual pass vouchers:
Paid annual passes and annual pass vouchers cannot be exchanged or (partially) refunded.

 

8. Use of the annual pass

8.1. Period of validity: The annual pass is valid for 12 months from the date of issue (until the last day of the respective expiry month) and entitles the person named on the annual pass to unlimited visits to the Leopold Museum. In the case of annual passes issued to companies, proof of company affiliation (e.g. a valid employee ID card) must be presented when visiting the museum.

8.2. The regular annual pass (digital and in credit card format) is not transferable and is only valid in combination with a valid photo ID.

8.3. For the reduced annual pass (digital and in credit card format), the following proof of identity must be shown at every visit to the museum:

• Proof of age: official photo ID with a date of birth under 30 years or 65 years or older.
• People with disabilities: disability pass.
• Members of the Association of Art Historians and Art Mediators must show proof of membership in the Association of Art Historians and Art Mediators in addition to their official photo ID.

8.4. The customer is obliged to show the digital annual pass on his/her mobile device during all visits to the museum, unless the customer has an annual pass in credit card format. The PDF of the digital annual pass can also be presented in printed form. In this case, the customer is responsible for ensuring that the printed annual pass is legible. Printed annual passes that contain illegible or unverifiable information will not be accepted. The customer may only make one printed copy of the annual pass. He/she must take all reasonable measures to prevent the duplication of the annual pass.

 

9. Annual pass renewal

An annual pass can be renewed at the earliest on the 1^st of the month in which the validity of the pass ends. Annual pass holders will be informed automatically by e-mail from the earliest possible date on which a pass extension is possible. If an annual pass is purchased earlier than this, it is not a renewal, but the purchase of a new annual pass independent of the previous annual pass and therefore the original term of the existing pass expires.

 

10. Delivery address and communication

Annual pass holders undertake to notify the Leopold Museum in written form of any changes to their delivery address (e-mail address and/or postal address). If the annual pass holder fails to do so, declarations by the Leopold Museum will be deemed to have been received by him/her if the Leopold Museum sends them to the last e-mail address or postal address provided by the annual pass holder.

 

11. Tracking

All visits to the museum are recorded (person, day and time) by scanning the personalized QR code on the annual pass, and the information is saved. Evaluations are never person-specific and serve purely to analyze general usage behavior and to improve the visitor experience.

 

12. Liability

12.1. The Leopold Museum is not liable for ensuring that the ordering of an annual pass via the website is possible at all times. The Leopold Museum shall only be liable to the customer for defects for whatever legal reason (e.g. damage resulting from malfunctions, errors or interruptions, as well as consequential damage) insofar as these were culpably or grossly negligently caused by the Leopold Museum.

12.2. The statutory warranty claims, in particular for consumers, shall remain unaffected by this.

12.3. The customer is obliged to provide all requested data completely and correctly. In the event of incomplete, incorrect or unclear information, the customer shall be liable for the resulting costs.

 

13. Warranty

The Leopold Museum shall be liable for defects within the scope of the statutory provisions.

 

14. Data protection

All information on data protection can be found in the data protection declaration on the Leopold Museum website at www.leopoldmuseum.org/en/dataprotection.

 

15. Applicable law and place of jurisdiction

15.1. The contract concluded shall be governed by Austrian law to the exclusion of the international rules of reference.

15.2. All disputes arising out of or in connection with this contract shall be settled before all competent courts having their seat in Vienna.

 

16. Amendments to these Terms and Conditions

The annual pass holder shall be notified of any amendments to these terms and conditions; such notification may also be made by e-mail. The annual pass holder shall accept the amended terms and conditions if she/he does not object to them in writing within 14 days of notification. The annual pass holder’s attention will be drawn to the 14-day period, the start of the period, the possibility to object in writing and the significance of failing to object in the notification. The Leopold Museum reserves the right to change the general terms and conditions at any time.
